ANJANA MISHRA ORAL ORDER 16-08-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, being the husband of the deceased lady, is apprehending his arrest in connection with Kahalgaon (Rasalpur) P.S. Case No.235 of 2017 for allegedly having committed the offence under Section 302 of the Indian Penal Code.

It appears from a bare perusal of the F.I.R. that the incident occurred out of anger and as stated there was no dispute for the demand of dowry.

The allegation is that there was some dispute between the sister and brother-in-law of the informant, who was informed by his nephew, son of the deceased, that out of

Patna High Court Cr.Misc. No.35519 of 2017 (2) dt.16-08-2017 2/2 sheer anger his father had assaulted his mother, leading to her death.

Considering the nature of allegations made and the petitioner is having three children to support, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon (Rasalpur) P.S. Case No.235 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
