JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-04-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Sirdalla P.S. Case No. 259 of 2017 for the offences punishable under sections 147, 148, 149, 341, 307, 379 and 302 of the I.P.C.

Allegedly, in the occurrence the petitioners and other co-accused assaulted brother and mother of the informant. Submission is of false implication and that the occurrence has taken place due to the land dispute, these petitioners are ladies, in the written report there is specific allegation against co-accused Rajendra Choudhary and Dilip

Patna High Court Cr.Misc. No.17361 of 2018 (2) dt.11-04-2018 2/2 Choudhary for assaulting the father of the informant resulting the father of the informant sustained serious injury and became unconscious and during treatment subsequently he died, in this case similarly situated other co-accused, namely, Usha Devi, Kaushalya Devi and Rinki Devi have been allowed pre-arrest bail in Cr. Misc. No. 3855 of 2018, vide Annexure-5, and as such the petitioners deserve sympathetic consideration. The learned A.P.P. fairly submits that other ladies coaccused have been allowed pre-arrest bail by another co-ordinate Bench of this Court.

In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M-V, Nawada in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
