The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 323, 420, 406, 504 of the Indian Penal Code.
Allegedly, the informant and other persons gave Rs.85,000/- per person to the petitioner for sending them to foreign. There is allegation of cheating against the petitioner under false promise to send the informant and other villagers to foreign country.
It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. He submits that the petitioner is ready to pay Rs.3,40,000/- to
Patna High Court CR. MISC. No.69450 of 2022(3) dt.08-05-2023 2/2 the informant. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, since the petitioner is ready to pay Rs.3,40,000/- to the informant, let the above named petitioner, be released on provisional bail for a period of eight months, in the event of his/her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Jaynagar P.S. Case No.655 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The provisional bail of the petitioner shall be confirmed by the learned Court below within a period of eight months, after satisfying that the petitioner has paid the said amount to the complainant.
