JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sandesh P.S. Case No. 109 of 2022 registered for the offences punishable under Sections 341, 323, 504, 506, 379, 307/34of the Indian Penal Code.
As per the prosecution case, on 25.05.2022 while the informant was sleeping in her house, she saw petitioner fleeing away taking cash and jewellery from the house of the informant.
Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.70304 of 2022(2) dt.04-04-2023 2/2 both the parties are Gotiyas and after delay of four days FIR has been lodged. There is case and counter case between the parties. Injuries sustained by the informant are simple in nature. Petitioners claim clean antecedent.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur in Sandesh P.S. Case No.109 of 2022 subject to condition as laid down under Section 438(2) of the Cr.P.C.
