The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

As per prosecution case, informant alleged that on 19.12.2021, while he was returning home after completion of his work, in the meantime, the petitioner along with co-accused persons intercepted him and snatched Rs. 800, Vivo mobile and other articles and fled away.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on basis of criminal history. Neither the petitioner is named in FIR nor he has put on

No any incriminating articles have been recovered from the conscious possession of this petitioner rather his name came into light on the disclosure of spy. It is further submitted that the petitioner is languishing in judicial custody since 19.01.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rajnagar P.S. Case No. 356 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VIIIth Madhubani.
