JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 20-02-2025 Heard learned counsel for the petitioner, Mr. Shantanu Kumar, learned APP for the State and learned counsel for the opposite party No.2.
2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 468, 469, 471 and 506 of the Indian Penal Code and Sections 66(C), 66(D), 66(E) and 67(A) of the I.T. Act.
3. The case of the prosecution is that the daughter of the informant, namely, Alka Kumari was having training of GNM. During training she developed relationship with the petitioner (Deepak Kumar). It is further alleged that the

No.73826 of 2024(4) dt.20-02-2025 2/3 petitioner has taken the obscene photographs of the daughter of the informant and he has uploaded the photo on Facebook through fake IDs. It is further alleged that the mother of the petitioner asked the informant to marry his daughter with the petitioner otherwise the petitioner is having sufficient material to ruin her.

Learned counsel for the petitioner has submitted that during course of investigation the victim has given her statement under Section 161 Cr.P.C. wherein she has stated that she accepted the friendship request of the petitioner and he has anyhow taken her obscene photographs which were uploaded on different Facebook accounts which are fake. Learned counsel further submits that the case is triable by the Magistrate and maximum punishment is three years. The petitioner is having no criminal antecedent and he is in jail since 04.07.2024.
5. The application for bail is opposed by learned APP for the State as well as by the learned counsel for the opposite party No.2.
6. Having heard learned counsel for the parties and considering the above facts and circumstance of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing
Patna High Court CR. MISC. No.73826 of 2024(4) dt.20-02-2025 3/3 bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the court of learned A.C.J.M. 1st, Begusarai in connection with Cyber P.S. Case No. 29 of 2023.
7. Accordingly, the present bail application stands allowed.
