The present writ application has been filed for the purpose of proper investigation in connection with Nawada Town P.S. Case No. 299 of 2021 lodged under Sections 420, 467, 468, 471, 354, 385, 323, 379, 504, 506 & 36 of the I.P.C. Counsel for State submits that this case may be disposed off in the light of order passed in Surendra Singh Vs. The State of Bihar & Ors. in Cr. WJC. No. 153 of 2017 and
Patna High Court CR. WJC No. 1501 of 2022(3) dt.25-04-2023 2/2 analogous cases decided on 09.09.2022.
Counsel for the State submits that counter affidavit is already on record.
In this view of the matter, the present criminal writ petition is disposed off with direction to the petitioner to file representation before the Superintendent of Police, Darbhanga in the light of the order passed in Surendra Singh Vs. The State of Bihar & Ors. in Cr. WJC. No. 153 of 2017 with analogous cases decide on 09.09.2022 within four weeks' from today and the Superintendent of Police, Darbhanga shall consider the representation and take appropriate action.
