Petitioner, who is in custody, seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)a, 26/35 of the Arms Act.

Informant who is a police officer has alleged in his written complaint that on 03.07.2019 at about 5:40 P.M. on receiving a confidential information that 10-12 miscreants have assembled with motorcycle to commit some grave crime and informant raided said place where five miscreants including

No.69131 of 2019(3) dt.16-01-2020 2/3 petitioner were apprehended however, remaining miscreants managed to escape and from possession of petitioner one motorcycle without registration was recovered. There is allegation of recovery of arms from other accused. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to previous dispute. Petitioner has no criminal antecedent and is in custody since 04.07.2019. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chhapra, in connection with Chhapra Muffasil P.S. Case No. 256 of 2019, subject to conditions:

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will
