NILU AGRAWAL ORAL ORDER 22-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner is languishing in judicial custody since 05.05.2017 in connection with Simri P.S. Case No. 40 of 2017 registered for the offence punishable under Sections 364(A) and 365 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that wife of one Anil Sahni received ransom call for payment of Rs. 50,000/- for release of son-in-law of the informant, namely, Sakal Deo Sahni, otherwise he
Patna High Court Cr.Misc. No.36605 of 2017 (2) dt.22-08-2017 2/3 would be killed. Certain mobile numbers were given in the First Information Report from which call was made. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent and the mobile from which call was made belonged to Sajjan Mahto and Govind Mahto. It is further submitted that one of the co-accused has been granted the privilege of bail by a coordinate Bench of this Court in Cr. Misc. No. 32007 of 2017 on 28.07.2017 and that a compromise has been entered into between the parties and a petition to that effect has been filed before the learned Court below.
However, learned A.P.P. for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Simri P.S. Case
Patna High Court Cr.Misc. No.36605 of 2017 (2) dt.22-08-2017 3/3 No. 40 of 2017, subject to the condition that both the bailors would be close relative of the petitioner.
