JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 23.08.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner is in jail custody since 9.3.2016 in a case registered under section 379 of the IPC on the ground that one stolen motorcycle was recovered from his house and on the basis of his information, eight stolen motorcycles were recovered from abandoned place.

Submission on behalf of the petitioner is that charge against the petitioner was framed on 11.4.2017 but up till now not a single prosecution witness has been examined.

Considering the period of detention of the petitioner in jail custody as well as stage of the case, let the
