2. The petitioners seek bail in connection with Giryak (Katrisarai) P.S. Case No. 255 of 2025 instituted for the offences under Sections 318(4), 319(2), 336(3), 61(2), 338, 340(2), 126(2), 115(2) & 132 of the Bharatiya Nyaya Sanhita, 2023 and Sections 66(c), 66(d) of the IT Act.

3. The prosecution case is that the petitioners along with others was found in a cowshed engaged in cyber cheating through mobile phones.

4. Learned counsel for the petitioners submitted that the

Patna High Court CR. MISC. No.69358 of 2025(2) dt.23-09-2025 2/2 petitioners have falsely been implicated in the present case. Except one mobile phone each, no incriminating article has been recovered from the conscious possession of the petitioners. Learned counsel further submitted that petitioners have got no concern with the alleged offence. It has been submitted on behalf of the petitioners that the petitioners are in custody since 13.06.2025 and have one criminal antecedent. Other co-accused has been granted bail by this Court vide order dated 18-09-2025, passed in Cr. Misc. No. 67729 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioners and claim based on parity, this Court is inclined to grant bail to the petitioners.

7. Let the petitioners be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Giryak (Katrisarai) P.S. Case No. 255 of 2025.
