This application is for grant of regular bail in connection with Ioilwar P.S.Case No.179 of 2016 , registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
The petitioner is not named in the FIR and it appears that his name transpired on the basis of CDR location and the other materials.
Submission of the learned counsel for the petitioner is that except the fact that the last call was made to the deceased by the mobile of the petitioner, there is absolutely nothing against the petitioner, whereas there is suspicion against the co-accused, Guddu Rai as his sister had love affair with the deceased and later on after failing in love affair, she has committed suicide. So far
Patna High Court Cr.Misc. No.37231 of 2017 (3) dt.01-09-2017 this petitioner is concerned, there is no motive against him and he is in custody since 10.6.2017.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the petitioner may renew his prayer for bail after framing of charge in this case before the court concerned itself, who will consider the same and will pass appropriate order. With the aforesaid observation, this application is dismissed.
