The petitioner has renewed his prayer for bail in a case registered under sections 307, 324 and 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, the petitioner is said to have fired two shots from his pistol hitting the informant in his abdomen.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 1.4.2022(Annexure-1) passed in Cr. Misc. no. 52011 of 2021. The petitioner has been falsely implicated in the case as a result of land dispute between the parties. In a case under section 307 of the Indian Penal Code the petitioner is in custody

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the petitioner having remained in custody since 26.6.2021 together with investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Sessions Trial no. 367 of 2021 (arising out of Warisnagar P.S. Case no. 209 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge X, Samastipur.
