This is an application for bail in connection with Mehsi P.S. Case No. 156 of 2017 registered for the offences punishable under Sections 393/34 of the Indian Penal Code. Allegation against the petitioner is of attempting to snatch money from the informant and he has been arrested at the spot.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case. Further submission is that there was altercation took place between the parties and co-accused persons having similar allegation have been granted bail by a co-ordinate Bench of this Court in Cr.Misc.No.42518 of 2017, vide order dated 19.9.2017 and petitioner is in custody for four months.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, East Champaran, Motihari, in connection with Mehsi P.S. Case No. 156 of 2017, G.R.No. 3387 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in disposal of trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine reason or without permission of court, his bail bond shall be cancelled.
