The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (a), 32(c) and 38(a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that allegedly the petitioner was seen fleeing away from Ambassador Car and on chase he was apprehended by the police who disclosed his name as Choti Kumar Yadav and from car 58 bottles each containing 750 ml and 230 bottles each containing 375 ml of foreign liquor were

Patna High Court Cr.Misc. No.36525 of 2017(2) dt.10-08-2017 2/2 recovered. Petitioner claims that he is having clean antecedent and is in custody since 24.04.2017.

Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Lakhisarai in connection with Lakhisarai (Kabaiya) P.S. Case No. 169 of 2017 with a condition that one of the bailors will be the resident of Bihar since the petitioner belongs to Jharkhand. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
