JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-11-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Again, I am not inclined to release the petitioner on bail though bail is sought on behalf of the petitioner on the ground that one co-accused Vakil @ Vakil Kumar@ Vakil Dujra@ Vakil Choudhary has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 15.03.2017 passed in Cr. Misc. No. 6667 of 2017 but in my view, the case of aforesaid co-accused is not similar to the case of this petitioner because there is specific allegation of firing against the petitioner and admittedly, only one firearm injury was found on the person of the deceased.

Accordingly, prayer for bail of the petitioner in

Patna High Court Cr.Misc. No.40663 of 2017 (3) dt.01-11-2017 2/2 connection with Budha Colony P.S.Case No. 245 of 2015 corresponding to Session trail no. 827 of 2016, pending in the court of Chief Judicial Magistrate, Patna stands rejected. However, the trail court is directed to expedite the trail of the petitioner and try to conclude the same as early as possible.
