This petition has been filed for modification of order dated 8.1.2018 passed in Cr. Misc. no. 48822 of 2017 by which petitioner was directed to surrender before the learned Trial Court within a period of eight weeks and deposit Rs. one lacs in favour of complainant as first installment.
Learned counsel for the petitioner submits that he could not surrender in time in terms of the order passed by this Court on 8.1.2018 in Cr. Misc. no. 48822 of 2017 because he could not arrange the money within 08 weeks as granted by this Court. It is further submitted that he has now arranged the
Patna High Court Cr.Misc. No.14866 of 2018(2) dt.11-04-2018 2/2 money and he makes prayer for extending the period by further four weeks.
In view of such, the order dated 8.1.2018 passed in Cr. Misc. no. 48822 of 2017 is modified to the extent that petitioner is given further three weeks time from the date of receipt of a copy of this order to surrender in the Court below i.e. learned ACJM, Xth Patna in connection with Complaint case no. 3549( C) of 2016.
The modification petition is allowed.
