The petitioner has prayed for bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

As per allegation in the FIR, when the informant was returning after his work by motorcycle, four miscreants on two motorcycle intercepted him by dashed his motorcycle as a result of which he fell down and on pistol point they snatched his mobile, purse containing Rs. 5500/-, helmet, belt, gold locket and fled away.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is innocent. Petitioner has not been put on TIP. Due to previous

Patna High Court CR. MISC. No.69302 of 2022(2) dt.28-02-2023 2/2 history, his name has been dragged by the police in the present case. Save and Except confessional statement of co-accused Satish Kumar, nothing is against the petitioner to show his involvement in the alleged crime. Petitioner is languishing in judicial custody since07.04.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sherghati, Gaya in connection with Amas P.S. Case No. 08 of 2022.
