1. Heard learned Senior counsel for the petitioner and learned APP for the State.

2. The petitioner has filed the instant application for grant of regular bail in connection with Special Case no.53 of 2023, arising out of Araria (Bairgachhi) P.S. Case no. 648 of 2023, registered under sections 8 and 20(b)(ii)(C), 25 and 29 of the NDPS Act.

3. The allegation in the FIR is of recovery of 85.9 kgs of ganja.

4. After some argument, learned Senior counsel appearing for the petitioner seeks permission to withdraw this application to file an appropriate application in the learned trial Court in view of the order dated 6.12.2023 passed in Cr. Misc.

Patna High Court CR. MISC. No.77541 of 2023(4) dt.07-03-2024 2/2 no. 65898 of 2023.

5. In view of the above, this application is permitted to be withdrawn with the aforesaid liberty.
