This application has been filed on behalf of the petitioner for modification of the order dated 22.08.2017 passed in Criminal Misc. No.2173 of 2017 by this Court with regard to extend the period of surrender of the petitioner in the court below in connection with Complaint Case No.1601 of 2015.
Learned counsel for the petitioner submits that vide order dated 22.08.2017 passed in Criminal Misc. No.2173 of 2017 by this Court, the petitioner was directed to be released on bail, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of the aforesaid order, on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.16078 of 2018(2) dt.21-03-2018 2/2 amount each to the satisfaction of the S.D.J.M., Gaya, in connection with Complaint Case No.1601 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C. but due to noncommunication of the said order, the petitioner could not surrender before the court below in connection with the concerned case and prays for extension of period of surrender of the petitioner in the court below in connection with the concerned case. In view of the aforesaid submission, let the period of surrender of the petitioner in the court below in connection with the concerned case be further extended for a period of four weeks from today. With the aforesaid modification in the order dated 22.08.2017 passed in Criminal Misc. No.2173 of 2017 by this Court, this application stands disposed of.
Let this order and the order dated 22.08.2017 passed in Criminal Misc. No.2173 of 2017 by this Court be communicated to the court of the S.D.J.M., Gaya, in connection with Complaint Case No.1601 of 2015.
