This application has been filed for restoration of the Cr. Appeal (S.J.) No. 1284 of 2017, which has been dismissed for non-compliance of the order dated 20.06.2017. It has been submitted on behalf of the petitioner that the petitioner has complied the order dated 20.06.2017 but the same could not be considered as valid compliance as such Cr. Appeal (S.J.) No. 1284 of 2017 was dismissed for noncompliance. Further, it has been submitted the order dated 20.06.2017 has now been fully complied with its letter and spirit. Heard learned A.P.P. also.

Having heard both the sides and considering the facts

Patna High Court Cr.Misc. No.37537 of 2017 (2) dt.09-08-2017 and circumstances of the case, this application is allowed and the Cr. Appeal (S.J.) No. 1284 of 2017 is restored to its original file. Accordingly, this application is disposed of. (Vinod Kumar Sinha, J) brajesh/- U T
