1. Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant.

2. A prayer for bail has been made on behalf of the petitioner in connection with Kalyan Bigha P.S. Case no.22 of 2025 registered under sections 316(3) and 318(4) of B.N.S, 2023.

3. The allegation in the F.I.R is that the the petitioner along with his father misappropriated the hard earned money of the farmers by not paying their money in lieu of their food grains.

4. Learned counsel for the petitioners submits at the outset that petitioner has been falsely implicated in the case. The name of the petitioner has been dragged in this case only for the reason that he happens to be son of Satyendra Kumar, who

Patna High Court CR. MISC. No.70840 of 2025(3) dt.17-11-2025 2/3 is involved in the business of food grains for the past 22 years and had misappropriated the money of the farmers. It is further submitted that petitioner is aged about 22 years only and hence, he could not have been involved in the said business since long time. Petitioner is a student and admit card of petitioner's college has been annexed as Annexure-P/2 of the petition. The petitioner is in custody since 13.05.2025 and he undertakes to co-operate in the case/trial. Charge-sheet has been submitted in the case.

5. Learned counsel for the informant has vehemently opposed the bail application of the petitioner and has also filed a counter affidavit which suggests that petitioner and his father have misappropriated the money of the poor farmers who are in huge debt because of their actions.

6. Taking into consideration the above mentioned facts of the case and also considering the fact that petitioner is a young boy and only assisting his father in the business, petitioner is in custody since 13.05.2025 coupled with the fact that petitioner's father Satyendra Kumar, who is primarily responsible for cheating the farmers and misappropriating their money, is in judicial custody and petitioner has no criminal antecedent, the petitioner is directed to be enlarged on bail in

Patna High Court CR. MISC. No.70840 of 2025(3) dt.17-11-2025 3/3 connection with Kalyan Bigha P.S. Case no.22 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned where the case is pending/Successor court.
