The petitioners have prayed for regular bail in a case instituted for the offence under Sections 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code.
The allegation against the petitioners along with others is said to have came at the informant's house and started abusing informant father and mother. It is further alleged that when his father and mother raised objection then co-accused
Patna High Court CR. MISC. No.4558 of 2023(2) dt.01-05-2023 2/3 assaulted by means of farsa and sword upon the informant's father and mother, due to which they fell down. Thereafter, they snatched of Rs. 20,000/-, gold chain and fled away. It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case. They have committed no offence. He submitted that there is general and omnibus allegation against these petitioners and no specific overt act has been alleged against them. It is further submitted that during the course of investigation injured Binod Sah, father of the informant, also made general and omnibus allegation of assault against the petitioners and other co-accused persons. The other co-accused has already been granted bail by a Co-ordinate Bench vide order dated 19.04.2022 passed in Cr. Misc. No. 65735 of 2021. They are languishing in judicial custody since 25.09.2022.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two
Patna High Court CR. MISC. No.4558 of 2023(2) dt.01-05-2023 3/3 sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran in connection with Chakia P.S. Case No. 196 of 2021.
