The present writ application has been filed seeking a writ in the nature of certiorari to quash the letter via Ref. No. R/PPU/958/19 dated 04.07.2019 issued under the signature of the respondent no. 2 whereby the petitioners have been deprived

Patna High Court CWJC No.19845 of 2019(3) dt.13-11-2019 2/3 from appearing in their B. Ed 1st Year Examination is most arbitrary and illegal way and in utter violation of natural justice. Learned counsel for the petitioners submits that other similarly situated writ petitioners whose prayer in the writ application have been rejected had come to the Court in an Intra Court Appeal which was disposed of on 17.10.2019 in the following terms :- "These three appeals have been filed by the candidates seeking protection of their admission in B.Ed Course.

The Colleges that had approached this Court have withdrawn their appeals, being LPA Nos. 1202, 1221, 1237, 1253, 1254, 1255, 1257 and 1301 all of 2019, in which orders have been passed by us seperately today.

In view of the liberty granted therein for approaching His Excellency, the Governor of Bihar, learned counsel for the appellants in these cases also pray for withdrawal of these appeals on the same terms in order to approach His Excellency, the Governor of Bihar, for redressal of their grievances.

The appeals are permitted to be withdrawn on the same terms."

Learned counsel for the petitioners thus, prays that the present writ application may also be disposed of in the light of the liberty extended by the LPA Court in LPA No. 1204 of 2019 arising out of CWJC No. 17366 of 2019.

Considering the fact that the petitioners are willing to
