2. The petitioner has preferred this application for grant of regular bail in connection with Uchkagaon P.S. Case No. 509 of 2023 registered for the offence punishable u/s 302 of the Indian Penal Code.

3. As per the prosecution case, the sister of the informant was married to the petitioner around 15 years ago and they had four children out of the wedlock. On 24.11.2023, the informant came to know that his sister was stabbed with a knife by the petitioner and she died during the course of treatment and before her death she had disclosed to the informant that it was the petitioner who stabbed her with a knife.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Learned counsel has further submitted that the informant is not an eye-witness and she has lodged this case on the hearsay statement of others. It is lastly submitted that the petitioner has clean criminal antecedent and is in custody since 03.01.2024 and there is no person who would look after the four children since the death of his wife.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and has stated that there is a specific allegation against the petitioner who have assaulted his wife with a knife causing grievous injury which resulted in the death of his wife.

6. Considering the aforesaid facts and circumstances of the case and also taking into account the fact that there is specific allegation against the petitioner who have assaulted his wife with a knife, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with Uchkagaon P.S. Case No. 509 of 2023 pending in the court of learned A.C.J.M.-XI, Gopalganj.

7. The application stands rejected.
