2. Petitioner seeks regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, there is recovery of 163.920 litres of foreign liquor from a pick-up bearing registration no. BR30G5806 which was driven by the petitioner who was apprehended at the place of occurrence.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Petitioner is driver of the vehicle in question and had no knowledge of the illicit liquor kept in the vehicle. Petitioner is not involved in illegal business of illicit liquor. Petitioner has clean antecedent and he is in jail since 09.08.2025 and he

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2, East Champaran at Motihari in connection with Excise P.S. Case No.1303 of 2025.
