2. At the very outset, the learned counsel for the petitioners has submitted that during the pendency of this anticipatory bail petition, petitioner no. 3, Sheikh Serajul has been arrested and, as such, it has become infructuous with respect to him. He, therefore, seeks permission to withdraw this petition with respect to petitioner no. 3, Sheikh Serajul.
3. In view of the aforesaid submission, this petition is
Patna High Court CR. MISC. No.70330 of 2025(3) dt.27-11-2025 2/3 dismissed as withdrawn with respect to petitioner no. 3, Sheikh Serajul.
4. The petitioner nos. 1 and 2 apprehend their arrest in connection with Shikarpur P.S. FIR No. 644 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 352, 351(2), 303(2)/3(5) of the BNS, 2023.
5. As per allegation, petitioners along with other coaccused persons are said to have abused and assaulted the informant with iron rod. When Sheikh Kalam came to save the informant, accused persons assaulted him with farsa. It is further alleged that petitioner no. 1 snatched Rs. 10,000/- from his pocket.
6. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. He has further submitted that there is land dispute between the parties and there is case and counter case between them. It has further been submitted that both sides have received injuries and injuries are found to be simple in nature.
7. Learned counsel for the informant and learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

8. Considering the above-mentioned facts and circumstances, let the petitioner nos. 1 and 2, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 644 of 2025, subject to the conditions as laid down under Section 438(2) Cr.P.C./ 482(2) of the BNSS, 2023. (Nawneet Kumar Pandey, J) priyanka/- U T
