JUSTICE SHIVAJI PANDEY ORAL ORDER 13-02-2018 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Mairwa P.S. Case No.344 of 2017, registered for the offence punishable under Sections 406 and 420 of the Indian Penal Code.

Allegation has been made against the petitioner that he has taken Rs.6,800/- from the informant for delivery of the passport, but later on, it appears that nothing has been done and he was not given any passport. Allegation has been made that the petitioner has taken the aforesaid amount from the complainant fraudulently.

Today, a supplementary counter affidavit has been

No.5914 of 2018 (3) dt.13-02-2018 2/2 filed, attaching the photocopy of the first page of the passport and also the letter dated 08.11.2017, which reflects that the passport has been delivered to the informant. Looking to the aforesaid facts, let the petitioner, namely, Rameshwar Singh, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VII, Siwan, in connection with Mairwa P.S. Case No.344 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) pawan/- U T
