JUSTICE ALOK KUMAR PANDEY ORAL JUDGMENT Date : 29-10-2024 In the instant petition, petitioner has prayed for the following relief(s):- (i) For issuance of an appropriate, writ/writs, order/orders, direction/directions to the respondent authority i.e respondent no. 3,5 and 6 to measurement and demarcation of petitioner's land. Bearing khata no104 plot no-413 Rakba-3.46 acre than no-743 mauza Kasma AnchalRafiganj Dist-Aurangabad. ii. For direction to respondent no. 4 and 7 to appear at time to measurement and demarcation of the land.

2. Learned counsel for the petitioner submits that land bearing Khata No. 104, Plot No. 413, Rakba - 3.46 Acre, Thana No. 743, Mauza Kasma, Anchal - Rafiganj, District - Aurangabad. He further submits that petitioner has submitted the format for measurement and demarcation of the aforesaid land on 29.03.2024, which is annexed as Annexure P/5 to the writ petition and no action has been taken by the concerned authority despite being the representation given by the petitioner even before the Circle Officer, Anchal - Rafiganj, District - Aurangabad and the Deputy Collector Land Reforms, Aurangabad. He further submits that he has also represented his grievance before the District Magistrate, Aurangabad.

3. Learned counsel for the State has submitted that there is no specific grievance raised by the petitioner before the competent authority as petitioner has submitted that he has only presumption that someone might have encroached the land of the petitioner.

4. The sole thrust of the petitioner is the measurement of the land in question and he has sought limited direction for the measurement of the said land.

5. In the light of the aforesaid facts and circumstances, the present writ petition stands disposed of as not

Patna High Court CWJC No.16650 of 2024 dt.29-10-2024 3/3 maintainable, reserving liberty to the petitioner to raise his specific grievance regarding measurement of land before the appropriate authority within a period of five weeks from the date of receipt of this order. The concerned authority is also hereby directed to hear the parties and pass appropriate order, in accordance with law, within six weeks from the date of his representation.
