2. The petitioner seeks bail in connection with Khaira P.S. Case No. 116 of 2019 registered for the offence punishable under Sections 147, 148, 302, 149 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the FIR, the petitioner is the assailant of the deceased. The deceased was shot four times and killed in broad day light by four persons.

4. The petitioner is in custody since 11.07.2025.

5. Learned counsel for the petitioner submits that the informant who is an eye witness has turned hostile in a connected trial, therefore, the petitioner deserves bail.

6. Considering the fact that the petitioner, as per the

Patna High Court CR. MISC. No.71368 of 2025(2) dt.13-10-2025 2/2 FIR, is one of the assailants of the deceased and in view of the judgment of the Hon'ble Supreme Court in the case of X vs. State of Rajasthan & Anr. reported in 2024 SCC Online SC 3539, when the trial has started, I am not inclined to grant bail to the petitioner.
