2. In view of the submissions and the grounds raised in the Interlocutory Application, the same is hereby allowed. The delay in filing the civil review application stands condoned. Re.: C.Rev. No. 300 of 2024

3. Heard Mr. Md. Anisur Rahman, learned counsel for the review petitioners and Mr. Ebadur Rahman, learned counsel for the State.

4. The present application has been filed seeking review of the order dated 13.02.2024 passed in CWJC No. 6644 of 2019 by a co-ordinate Bench of this Court.

5. Learned Advocate for the review petitioners submitted that the date on which the order dated 13.02.2024 came to be passed on account of certain unavoidable circumstances, he could not appear and in his absence the order has been passed, based upon the averments made in the counter affidavit, which is not correct.

6. On the other hand, learned Advocate for the State submits that non-appearance of the petitioners or their counsel cannot be a ground to review the order.

7. In view of the aforesaid facts and considering the settled position that non-appearance of a counsel or on account of his laches, it cannot be a ground to review an order, unless it

8. Accordingly, the present review application stands dismissed.
