Petitioner apprehends his arrest in connection with Nawada Town P.S. Case No.418 of 2017, for the offence punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

The allegation against the petitioner is that petitioner along with co-accused persons, Khurshid and Dharmendra Kumar assaulted the informant.

Learned counsel for the petitioner submits that petitioner is not named in the FIR and as per the allegation, coaccused Khurshid and Dharmendra assaulted the informant along with 5 to 6 unknown persons. Learned counsel further

Patna High Court CR. MISC. No.65219 of 2019(2) dt.25-10-2019 2/2 submits that petitioner has got no criminal antecedent and his name has transpired allegedly during the course of investigation. Learned counsel further submits that no specific allegation of assault is made upon the petitioner.

Having regard to the submissions made by the parties and taking into consideration the fact that petitioner is not named in the FIR and the allegation of assault in the FIR is against other co-accused persons, Khurshid and Dharmendra, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner, above named, is directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by him, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
