The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 414 of the Indian Penal Code and Sections 25(1-B) (A)/26/35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to suspicion. He submits that no incriminating article has been recovered from the possession of the petitioner. He submits that name of the petitioner has come in this case on the basis of confessional statement of Om Prakash Sharma who has already been granted bail by the court below itself. He further submits that petitioner has one criminal antecedent as stated in para-2 of the supplementary affidavit.
Patna High Court CR. MISC. No.71670 of 2022(2) dt.30-01-2023 2/2 Learned APP for the State opposes the prayer for bail and submits that the petitioner was involved in committing the crime at railway station platform. .
Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with GRP/Kiul P.S. Case No. 82 of 2022.
