JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-03-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302, 326/34 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, two F.I.R. named accused persons including some unknown persons committed the murder of the father of informant.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has transpired in this case during the course of investigation in the confessional statement of co-accused, Birendra Verma and only material that has come against this petitioner is that he had visited the house of co-accused in the year 2020. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, Begusarai in connection with Bakhri PS case No. 87/ 2021, subject to conditions laid down u/s 438(2) of the Cr.
