2. The petitioner is apprehending his arrest in a case in connection with Marhowrah P.S. Case No. 13 of 2017 dated 09.01.2017 registered for the offences punishable u/ss 419, 420, 467 read with section 34 of the Indian Penal Code.

As per the prosecution case, the petitioner and the other co-accused persons are alleged to have submitted forged and fabricated documents to avail the Life Insurance policy in the name of deceased Chandrama Singh and thereby tried to obtain the death claim of Rs. 1,78,000/- from the Insurance Company illegally.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.75790 of 2023(2) dt.14-12-2023 2/3 that the petitioner has falsely been implicated in this case. It is further submitted that the petitioner is quite unaware regarding any proposal form submitted by the policy holder who is the father of the petitioner for issuance of Life Insurance Policy in which the petitioner has been made as the nominee of the policy holder.

It is further submitted that the proposal for providing the Insurance policy to the deceased (father of the petitioner) was furnished by the concerned policy agent/ Insurance consultant Dheeraj Shukla, who in connivance with the Company Manager has furnished the insurance proposal in favour of the deceased after preparing and submitting all the required documents along with the report of his finding regarding the life to be assured by producing manufactured document and proposing the name of the petitioner as nominee of the policy holder, only in order to grab the amount by playing fraud upon the Insurance Company. Learned counsel has further submitted that the petitioner has no concern with the alleged offence and no amount of the Insurance Company was misappropriated by the petitioner.

The petitioner has no criminal antecedent as stated at para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Saran at Chapra in connection with Marhowrah P.S. Case No. 13 of 2017, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.

7. The application stands allowed.
