JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Barachatti P.S. Case No. 367 of 2017 instituted for the offence under Sections-272, 273, 34, 120(B) of the Indian Penal Code and Section-30(a), 33, 38, 47 of the Bihar Prohibition and Excise Act, 2016.
It is alleged that total 420 litres of spirit kept in 14 gallon each gallon contains 30 litres have been recovered from the back side of red colour Sumo, on which, the petitioner was found sitting. In paragraph-3 of the petition, it has been mentioned that the petitioner has no criminal antecedent. The petitioner is said to be in custody since 1806-2017. In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Barachatti P.S. Case No. 367 of 2017
