JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-04-2018 The petitioner is apprehending his arrest in connection with Complaint Case No. 2191 of 2015, registered for offences punishable under Sections 406 and 420 of the Indian Penal Code. Prosecution case is that informant gave Rs. 1,40,000/- to the petitioner for supply of Aadhar Card Making Machine but he could not supply the said machine and when the informant asked for his money, petitioner gave him cheque, which was dishonored by the bank and petitioner is not returning the money of informant, by this way, the petitioner cheated the informant. It has been submitted on behalf of the petitioner in fact the petitioner has supplied the old Aadhar Making Machine as per
Patna High Court Cr.Misc. No.13586 of 2018 (2) dt.06-04-2018 2/2 agreement and when they went out of order, informant started demanding the money, however, when confronted with the learned counsel for the complainant that the petitioner has criminal antecedent as he has been involved in other cases of cheating like the present one, learned counsel for the petitioner has sought permission to withdraw the present application. Heard learned A.P.P. also.
Having heard both sides, in view of above this application is dismissed as withdrawn.
