This is an application for bail in connection with Raghunathpur P.S. Case No. 16 of 2017 registered for the offences punishable under Sections 341, 323, 324, 307 and 504 of the Indian Penal Code.
Allegation against the petitioners is of assaulting the informant by knife and bricks and causing injuries to him, which appear to be incised would and grievous in nature. Submission of learned counsel for the petitioners is that there was no pre-plan and at the spur of moment the occurrence took place and informant and petitioner No.1 are full brothers and petitioners Nos. 2 and 3 are sons of petitioner No.1 and they are in
Patna High Court Cr.Misc. No.40196 of 2017 (2) dt.24-08-2017 2/2 custody for two months.
Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and considering the facts and circumstances and also considering the nature of injury, I am not inclined to grant bail to the petitioners at this stage. However, petitioners may renew their prayer for bail after framing of charge in this case.
