JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-11-2017 This appeal has been filed against the order dated 4.2.2017 by which learned Additional Sessions Judge-X-cumSpecial Judge, SC/ST Act, Muzaffarpur has taken cognizance on protest petition filed by the informant.

Submission of learned counsel for the appellants is that as a matter of fact police after investigation submitted final form not finding case true and on protest petition cognizance has been taken. Further submission is that there is land dispute between the parties from before and, as such, final form has been submitted and cognizance has been taken against the appellants on protest

Having heard both sides and from perusal of the petition it appears that there is allegation of abusing against the appellants and further they have tried to grab the land of the informant and there is prima facie case available on record, hence this appeal is dismissed being devoid of merit.
