====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Patna Junction P.S. Case No. 278 of 2017 registered for the offence punishable under Sections 401, 414 of the Indian Penal Code read with Sections 137, 147 of the Railway Act. The case of the prosecution is that the petitioner along with one another was apprehended at the railway station by the police officials and one mobile and Rs. 1000/- were recovered from his possession.

The learned counsel for the petitioner submits that the petitioner has a clean antecedent and mere recovery of the aforesaid article do not make out a case for the offence punishable under Sections 401 and 414 of the Indian Penal Code.

Patna High Court Cr.Misc. No.37915 of 2017 (2) dt.10-08-2017 2/2 Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Railway Additional Chief Judicial Magistrate, Patna in connection with Patna Junction P.S.
