JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2018 The petitioner is apprehending his arrest in connection with Jamalpur P.S. Case No. 184 of 2017, registered for offences punishable under Sections 364/34 of the Indian Penal Code. Allegation against the petitioner and others is of kidnapping the son of informant.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case due to family dispute and has nothing to do with the kidnapping of the boy and witnesses has not supported the allegation of kidnapping by the petitioner. Heard learned A.P.P. also.

Having heard both sides, considering the fact and circumstances of the case and also the fact that the boy has named this petitioner in his statement, as such, I am not inclined to grant

Patna High Court Cr.Misc. No.12122 of 2018 (3) dt.03-04-2018 2/2 the privilege of anticipatory bail to this petitioner, this application is accordingly dismissed.

However, the petitioner may surrender before the court below and pray for regular bail, the trial court shall consider the same on the merit of the case and shall pass an appropriate order, without being prejudiced by the order of this Court. (Vinod Kumar Sinha, J) sunil/- U T
