JUSTICE SANJAY KUMAR ORAL ORDER 21-08-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Banka P.S. Case No. 188 of 2017 instituted for the offences punishable under Sections 147, 149, 337, 353, 431, 427 and 438 of the Indian Penal Code.

It has been submitted that on the date of occurrence, one school going girl was dashed to death by a vehicle, which was subsequently set on fire by a mob of 500 persons. The learned counsel for the petitioner submits that the allegation of firing to the said vehicle is not specific against the petitioner. The petitioner has no concern with the alleged occurrence. Six co-accused persons have been allowed anticipatory bail by co-ordinate Benches of this Court in

Patna High Court Cr.Misc. No.39525 of 2017 (2) dt.21-08-2017 2/2 Criminal Miscellaneous Nos. 28598 of 2017 and 29210 of 2017. The case of this petitioner stands on similar footing and so, he deserves anticipatory bail.

The learned A.P.P. for the State opposed the submission.

Considering the case of this petitioner on similar footing, the anticipatory bail prayer is allowed. The petitioner, above named, in the event of arrest / surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka P.S. Case No. 188 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
