JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

In huge quantity Indian made foreign liquor was recovered from Tata Sumo Gold vehicle and allegedly, petitioner and some others were found sitting in the said vehicle. However, learned counsel appearing for the petitioner submits that Hyundai Santro car of the petitioner was intercepted by the police and as a matter of fact, petitioner was found sitting in his Hyundai Santro car from which nothing incriminating article or countrymade liquor was recovered but police falsely implicated

It is further submitted that persons, who were found sitting in Tata Sumo Gold vehicle, have already been granted privilege of bail by a co-ordinate Bench of this court vide order dated 22.10.2019 passed in Cr. Misc. No. 67219 of 2019.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IInd cum Special Judge Excise Act, Begusarai in connection with Bachhwara P.S. Case No. 164 of 2019.
