2. The petitioners apprehend their arrest in connection with Rosera P.S. Case No.143 of 2023, registered for the
Patna High Court CR. MISC. No.71977 of 2023(2) dt.07-11-2023 2/3 offences punishable under Sections 363, 365/34 of the Indian Penal Code.
3. As per allegation, the son of the informant was working as a labourer in Banglore where the petitioners were also working. On 16.02.2023, the petitioners kidnapped the son of the informant with an intention to marry him with daughter of the petitioner No. 1.
4. Learned counsel for the petitioners has submitted that the FIR shows that the victim of this case was kidnapped by the accused persons for solemnizing marriage with daughter of petitioner No. 1. As a matter of fact, the victim had committed rape upon the daughter of the petitioner No. 1 and he is under custody. The petitioners have falsely been implicated in this case. There is delay of two days in lodging the FIR.
5. There is allegation that a case has been lodged on son of the informant for the offence of commission of rape upon the daughter of Petitioner No. 1 which appears to be the reason for false implication of the petitioners.
6. Considering the above-mentioned facts and circumstances, in the event of their arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten
Patna High Court CR. MISC. No.71977 of 2023(2) dt.07-11-2023 3/3 Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Rosera in connection with Rosera P.S. Case No.143 of 2023, subject to the conditions as laid down under Section 438(2) CrPC.
