2. The petitioner seeks regular bail in a case registered for the offence under Sections 147, 148, 149, 341,323, 354A, 302 and 379 of the Indian Penal Code.

3. As per the prosecution case, all the F.I.R. named accused persons including this petitioner and 10 unknown persons are said to have assaulted the deceased.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The specific allegation of assault is against co-accused Naresh Yadav. The petitioner is in jail since 11.02.2023. It is further submitted that other co-accused persons have already been granted bail.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances of the case, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran, Motihari/concerned Court below in connection with Harsidhi P.S. Case No. 387 of 2022 subject to condition that:- 7(i)The petitioner shall cooperate in the trial and shall be properly represented by himself or through his laywer on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
