JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-08-2017 The petitioner seeks regular bail in connection with Barahiya P.S. Case No. 105 of 2017, registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a), 32 (c), 38 (b) and 41(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 24 litres of foreign liquor from the house of the petitioner.

It has been submitted on behalf of the petitioner that the house from which the alleged recovery has been made is a joint house and nothing has been recovered from the conscious possession of the petitioner and has falsely been implicated in this case and has no criminal antecedent and has been in judicial custody since 30.05.2017.

Patna High Court Cr.Misc. No.37717 of 2017 (3) dt.31-08-2017 2/2 Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, nature of allegation and period of custody, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge -II Cum Special Judge, Excise Act, Lakhisarai, in connection with Barahiya P.S. Case No. 105 of 2017.

It is made clear that if the petitioner again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of his bail bonds.
