JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-08-2017 Heard learned counsel for the petitioners and State. The petitioners are accused in Kudra P.S. Case No. 90 of 2017 for the offences under Sections 341, 323, 354, 379, 504/34 of the Indian Penal Code.
From the FIR it appears that there is allegation against the petitioner No.2 that he took away Rs. 10,000/- from the pocket of the informant and thereafter the petitioner No.1 along with another co-accused went to the house of the informant and abused the sister of the informant and tore her blouse. Counsel for the petitioners submits that the petitioners and the brother-in-law of the informant are Gotias and there is boundary dispute and as such the petitioners and others
Patna High Court Cr.Misc. No.38362 of 2017 (2) dt.19-08-2017 2/2 have been falsely implicated in this case.
Considering the statements made in para-3 on affidavit that the petitioners have no criminal antecedent and also that the petitioners and the brother in-law of the informant are Gotias and there is dispute as to the boundary, let petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua or the successor Court in connection with Kudra P.S. Case No. 90 of 2017, subject to the condition that the petitioners will extend full cooperation in the conclusion of the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
