JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 13-04-2018 It is submitted by the learned counsel for the petitioner that though this application has been filed for setting aside the order dated 13.07.2017 passed in Sessions Trial No.47 of 2015 whereby the learned Additional Sessions Judge-4th, Siwan had dismissed the discharge petition filed by the petitioner under Section 227 of the Code of Criminal Procedure, the charges have already been framed and by now three prosecution witnesses have already been examined. He submitted that due to efflux of time, this application has become infructuous.

Patna High Court Cr.Misc. No.42754 of 2017 (2) dt.13-04-2018 Accordingly, the application is dismissed as infructuous.
