JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 The petitioner seeks regular bail in connection with Aurangabad Muffasil P.S. Case No. 192 of 2016, registered for offences punishable under Sections 30(a) of the Bihar Excise Amendment Act, 2016.

Allegation is of recovery of 240 litres of foreign liquor from the vehicle of the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has nothing to do with the alleged recovery as he was owner of the said vehicle from the alleged recovery has been made and the same was being run by the driver. Further petitioner has no criminal antecedent and has been in judicial custody since 29.06.2017 Heard learned A.P.P. also.

No.38241 of 2017 (4) dt.24-08-2501 Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the court below to release the petitioner on bail to his own satisfaction after framing of charge in this case or after completion of three months of judicial custody of the petitioner, whichever is earlier.
