JUSTICE SANJAY PRIYA ORAL ORDER 09-04-2018 Supplementary affidavit has been filed by the learned counsel for the petitioner. Let it be kept on the record. Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner apprehends his arrest in Piar P.S. Case No. 80 of 2016 instituted for the offence under Sections 384 and 392/34 of the Indian Penal Code.
Learned counsel for the petitioner after perusing the case diary has submitted that process has already been issued against this petitioner and the same has been executed as mentioned in paragraphs 114 and 118 of the case diary. Learned counsel for the informant has appeared and
Patna High Court Cr.Misc. No.12245 of 2018 (3) dt.09-04-2018 2/2 opposed prayer for anticipatory bail of the petitioner. Since Process has already been issued against the petitioner as would appear from Paragraphs 114 and 118 of the case diary, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail which shall be considered by the court below on its own merit without being prejudiced by this order, if possible, on the same day.
